This was an action on the case, brought by Ebenezer Barber, against the city of Quincy, to recover damages for an injury resulting from a fall on a sidewalk of the city, on the 2d day of February, 1873. A trial of the cause before a jury resulted in a verdict in favor of the plaintiff for $1000. The court overruled a motion for a new trial and rendered judgment on the verdict; to reverse which this writ of error was brought.
