Tlie record discloses that a petition for divorce and custody of a child was filed by Yesta Snow against Horace Snow in the Thirty-seventh district court of Bexar county, on September 11, 1919, and that a divorce was granted on October 11, 1919. On December 8, 1919,' appellant filed a motion to set aside the judgment on the ground that it was granted before the expiration of 80 days after the suit was filed. The mo_tion was overruled, and from that order this appeal was perfected.
