This litigation arose out of the following facts: Section 1 pf an ordinance of the city of Austin makes it unlawful for any person to erect, maintain, and operate any gasoline filling station within its corporate limits without first obtaining a permit from the city council. 'Section 2 defines the term “gasoline filling station” as used in the ordinance. Section 3 reads as follows: “That in granting or refusing the permit provided for in Section 1 of this ordinance, the City Council shall take into consideration the place where such filling station is proposed to be established, its…
