— In a negligence action to recover damages for personal injuries, etc., the plaintiffs appeal from (1) an order of the Supreme Court, Queens County (Lerner, J.), dated August 1, 1988, which granted the defendants’ motion to dismiss the complaint for failure to serve a proper notice of claim, and (2) a judgment of the same court, dated September 7, 1988, entered thereon.

Ordered that the appeal from the order is dismissed; and it is further,

Ordered that the judgment is reversed, on the law, the order is vacated, and the defendants’ motion is denied; and it is further,
