Hunter, Jr., J.), entered February 3, 2004, which, in an action for personal injuries, denied the motions by defendants Infra-Metals Corp. and Hunterspoint Steel Company for summary judgment dismissing the complaint as against them, unanimously modified, on the law, to the extent of granting defendant Infra-Metals Corp.’s motion, and otherwise affirmed, without costs.
