1. Tbe main facts are stated in the first headnote. Other facts will be stated as necessary. The mortgage given by William S. Moughon and Alice E. Moughon to Clement Master-son in 1875 was upon the land which had been set apart as a homestead, and not merely upon the “homestead estate.” The proceeding to foreclose it was also against the land. The grounds of the demurrer in the present case, based on the theory that the mortgage and the foreclosure proceeding were confined to something less than the land itself, are without merit.
