[1] During the period from January 1, 1906, to January 1, 1909, the defendant was sheriff of Franklin county, and received his regular yearly salary of $1,200 as fixed by statute. The particular charge made against him in this action is that during that period he presented bills, aggregating in amount $880.08 to, and which were paid by, the county treasurer of Franklin county, for caring for Chinese prisoners at the rate of 50 cents a week for each Chinaman committed to his custody and detained by him in the county jail.
