The petitioner herein entered a plea of guilty in the district court of Kay county of the crime of burglary, and was sentenced to serve a term of five years in the state penitentiary.

The record discloses that the defendant was arrested on the 20th day of July, 1927, under an order issued out of the county court of Kay county, charged -with the crime of burglary. Attached to petitioner’s application for the writ is a certified copy of the journal entry of judgment and sentence on defendant’s plea of guilty, which journal entry recites that on the 26th day of July, 1927, defendant was arraigned…
