This is the second appeal in this case: see Mortensen v. Ballard, 209 Ark. 1, 188 S. W. 2d 749, wherein the complaint is set out in extenso. On September 5, 1944, Mortensen filed suit seeking: (a) to have the defendant, Evelyn Pearson Ballard, declared a trustee for him in the real estate and corporate stock of the Pearson Hotel Company, and (b) judgment against the Pearson Hotel Company (a corporation) for money alleged to be due him for services rendered.
