M. A. Brown and T. P. Harris, as joint owners of a lot of land situated in Dublin, Erath County, sued the Texas Central Bailroad Company for damages for permanent injury to said land, growing out of the negligent construction of a railroad embankment containing insufficient culverts to accommodate the flow' of surface water, by reason of which facts plaintiffs’ land had been overflowed, and its value materially lessened.
