Appeal by the defendant, Edward 0. Underhill, from an interlocutory judgment of the Supreme Court in favor, of the plaintiffs, entered in the office of the clerk of the county of New York on the 27th day of July, 1903, upon the decision of the court, rendered after a trial at the New York Special Term, directing the defendant to file with a referee therein named a full and complete account of his proceedings as agent of the plaintiffs.

This action was brought to compel an accounting by the defendant of his proceedings and dealings with the property of the plain*126tiffs as their agent. The property for which an accounting is asked is within the jurisdiction of this court, and the defendant is a resident of this State. The plaintiffs reside abroad and have so resided during the period of the agency of the defendant. In 1866 certain property, consisting of cash, real estate and mortgages, owned by plaintiffs, came into the possession of the defendant in his capacity as agent for. them.
