— Appeal by defendant from a judgment of the County Court, Nassau County (Lawrence, J.), rendered March 23, 1981, convicting him of burglary in the third degree and criminal possession of stolen property in the third degree, upon a jury verdict, and imposing sentence. Judgment reversed, on the law, and new trial ordered. On August 31, 1980, during the early morning hours, the front window of the Hempstead Cycle Shop was smashed and two bicycles were stolen.
