BUSSEY, Judge.
F. E. Allcorn, Jr., was convicted in the District Court of LeFlore County, State of Oklahoma, of the crime of Larceny of Livestock, and appeals.
It is defendant’s first contention that the trial court abused its discretion in over ruling a Motion For Continuance, filed by defendant’s counsel on the 26th day of March, 1963 (the day of trial). In the Motion For Continuance, counsel for defendant asserted that he had been employed on the previous day (the 25th day of March, 1963) and had not had adequate time to prepare his defense.
