Seitz, Chancellor:

Plaintiff is the owner of certain real estate located in the City of Dover and brings this action challenging the legality of the 1956 assessment of real estate taxes. It requests an injunction restraining the City and its tax collector from collecting taxes from plaintiff based on that increased assessment.

Both the plaintiff and defendants have moved for summary judgment and this is the decision thereon. The governing charter will be referred to either as the “charter” or “statute”.
