McPHERSON, District Judge.
This is an action for a personal injury. At the close of plaintiff’s evidence defendant moved for an order directing the jury to find for the defendant. This motion was argued at length, and taken under advisement by the court until the following morning. Then in the presence of the jury and counsel for both sides the court at some length gave his views of the matter, and concluded with the following statement:
