On May 20, 1913, an opinion was handed down in this case reversing and remanding same. On the 4th day of June, 1913, a petition for rehearing was filed, and on the 4th day of November, 1913, same was granted. Through oversight the original opinion has been published in the official reports (37 Okla. 510, 138 Pac. 165) while the case was still pending on rehearing.
