This is the second time this case has been before us. See Robert O. Frye v. Ward Alford, trading as Al’s Cab, 203 Va. 461, 125 S.E. 2d 177.
Frye filed his motion for judgment against the cab owner seeking damages for personal injuries sustained in an accident which occurred in the city of Waynesboro between a truck operated by Frye and one of the defendant’s taxicabs. Frye alleged that the accident was proximately caused by the negligence of the cab owner. The cab owner filed grounds of defense together with a counterclaim alleging that he was entitled to recover for damages to his cab.
