This matter is before the court on third party plaintiff Aegis Security Insurance Company’s (“Aegis”) motion for sanctions in the form of attorneys’ fees and expenses, filed pursuant to USCIT R. 37(d), against third party defendant Matthew Fleming (“Fleming”). Aegis seeks an award of fees and expenses incurred as a result of Fleming’s failure to respond to Aegis’ interrogatories and other discovery requests, and failure to appear on the first day of a scheduled two-day deposition.
