The plaintiff was injured within the corporate limits of the city of Indianapolis, by a locomotive and ten der of the defendant, which was being rim upon the track of the Cincinnati, Cleveland, Columbus & Indianapolis Railway Company. The point where the injury occurred was north of Ohio street, between Ohio and Winston streets. At the point where the plaintiff was injured, and south of it, there are two tracks, the western one used for the trains *483going north, and the eastern one for the trains going south.
