Being unable to agree with the majority opinion herein, I am forced to file my dissent.

This is an appeal from a temporary injunction granted ex parte on the 31st day of October, 1936, enjoining appellant from prosecuting a trespass to try title suit in Rusk county.

The appellant contends that the injunction is void and should be dissolved, for the following reasons: First, because the petition for the injunction contained no prayer for a temporary injunction; second, because the injunction was granted ex parte, upon a petition which was not verified; third, because the appellee was not…
