The Appellate Division, in an opinion reported at 36 N. J. Super. 249 (1955), reversed the Chancery Division’s judgment which dismissed the plaintiffs’ complaint for declaratory relief. We granted certification under R. R. 1:10—2.
The defendant Associated Bealties Corporation is the owner of the Million Dollar Pier located at 2100-2114 Boardwalk, Atlantic City, and the -defendant Camden Trust Company holds a $601,000 fourth mortgage on the property in trust for bondholders.
