The Board of Commissioners of Putnam County (“the County”) sought summary judgment against Wendy Barefoot’s personal-injury action, alleging that the County was entitled to immunity from suit. The trial court denied the County’s motion for summary judgment, holding that sovereign immunity had been waived by the County’s purchase of liability insurance covering injuries arising from the “use” of a County vehicle.
