This motion by defendant seeking an order of this court vacating the previously entered judgment against the defendant is considered pursuant to CPL 440.10 (subd 1, par [a]) and 440.30 and is determined as follows:

The defendant herein was indicted for grand larceny in the second degree (three counts). Offering a false instrument for filing in the first degree (four counts) and four violations of subdivision (b) of section 1145 of the New York State Tax Law.
