The appellant was charged with the crime of murder. The jury found him guilty of manslaughter. He appeals from the judgment and also from the order denying his motion for a new trial. The district court of appeal reversed the judgment and the case comes before this court after an order granting a hearing herein. The facts in the case show substantially that the deceased met his death from a gunshot wound inflicted by the appellant on the eighteenth day of December, 1923.
