1Per curiam
This is an application for a writ of error by plaintiff in error who was tried and convicted of the crime of murder of the second degree in April, 1896, and sentenced to the penitentiary where he has ever since been confined. In March, 1898, he applied for and obtained from this court a writ of error to the judgment of conviction, and the transcript of the record and bill of exceptions were lodged with the clerk.
