Tbis is an action for the recovery of real estate. Tbe land in controversy is shown on the map, being tbe three-acre tract included within, tbe boundaries set forth in tbe complaint, also a strip on tbe southern border of tbe 150-acre tract. It is admitted that tbe title is out of tbe State. Tbe plaintiff claims title under a deed made on tbe 14th May, 1890, by W. M. Robbins, commissioner, pursuant to a decree made in a proceeding brought by tbe heirs of J. M. Harden for a sale for partition. Robbins conveyed tbe lands to the plaintiff and another.
