This appeal essentially addresses the partial denial of the appellants’ motion and cross motion to dismiss the complaint as to them on the grounds that a judgment of the United States District Court for the Eastern District of New York is res judicata of the causes of action alleged by the plaintiff, and that the recovery of a judgment against defendant Perry in favor of the plaintiff in the total sum of $140,000 ($80,000 in compensatory damages and $60,000 in punitive damages) precludes a second recovery by the plaintiff in this action.1 The judgment in the…
