This is a declaratory judgment proceeding involving the construction of the will of Hayden Reynolds. The will follows;

As I wish to give what I own to my heirs— will .try to block a plan. I wish to give' to Ellis the farm and he could pay Dock his interest in it in 3 years and then with Dock’s interest and his he would own ½ the worth of the estate, 'and borry the other half on the land and and deposit it in the bank for Earl and Virginia or put it in land or some thing where it wont' be easted or put in property and deed to them *816and heirs.
