Appeal from a *891judgment of the County Court of Albany County (Harris, J.), rendered July 9, 1986, upon a verdict convicting defendant of the crime of criminal sale of a controlled substance in the third degree.

Defendant’s previous conviction for the sale of a quantity of cocaine to a State Police undercover officer at Thruway exit 25 in Albany County on September 26, 1983 was reversed by the Court of Appeals and a new trial ordered (67 NY2d 111).
