Appeal by the defendant, The Atlantic Avenue Railroad Company, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Kings on the llth day of June, 1895, upon the decision of the court rendered after a trial at the Kings County Special Term.

Cullen, J.:
The plaintiff is the owner of land on the westerly side of Ninth avenue, in the city of Brooklyn, comprising the whole front of the block between President and Carroll streets. The defendant maintains and operates upon that avenue a double-track street surface *561railroad. In August, 1894, the defendant was relaying its main tracks on the avenue, and at that time constructed a turnout or siding, as a standing place for cars, opposite the plaintiff’s premises, hut on the other or easterly side of the avenue.
