MATTHES, Circuit Judge.
Appellant, Harry R. Smith, was indicted for entering a federally insured bank with intent to commit a felony; to wit, a larceny, in violation of 18 U.S.C.A. § 2113 (a). 1 He was found guilty by a jury and was sentenced to prison for a term of twenty years. His conviction was affirmed. Smith v. United States, 331 F.2d 265 (8 Cir. 1964), cert. denied, 379 U.S. 824, 85 S.Ct. 49, 13 L.Ed.2d 34, rehearing denied, 379 U.S. 940, 85 S.Ct. 321, 13 L.Ed.2d 350.
