In this straightforward case, the court is called upon to define the term “agricultural employment” as it appears in the Migrant and Seasonal Agricultural Worker Protection Act (MSPA) 29 U.S.C. § 1802(3). The precise issue presented is whether workers who engage in forestry work, such as planting, clearing brush, and the like, are engaged in “agricultural employment” so as to make applicable the remedial provisions of the Act regulating labor contractors in that area.
