This case was instituted in the Circuit Court of Wright County, returnable to the June term, 1931. The suit was by J. H. Fly, John Lay, and C. A. Coomer, plaintiffs, against C. H. Jackson, C. D. Shannon, Tom C. Short, John H. Hicks, J. E. Lewis and Hid W. Leach, defendants, and based on the following petition, caption, signatures and affidavit omitted:
