Peterson, Justice.. The defendant was found guilty of contempt for failure to obey an order directing him to pay plaintiff temporary alimony. To obtain a review he has appealed from the order and caused a writ of certiorari to be issued out of this court.
On September 9, 1940, plaintiff brought this action against defendant for separate maintenance.
