HARPER, Judge.

This is a companion case to that of Serrato, two Gonzales cases, 74 Texas Crim. Rep., 458 and 468, and Martinez case reported in 75 Texas Crim. Rep., 416, 171 S. W. Rep., beginning on page 1133, and the Vasquez case, reported in 74 Texas Crim. Rep., 491 171 S. W. Rep., 1160.

In this case appellant was adjudged guilty, and his punishment assessed at imprisonment for life in the penitentiary. Some of the ques tions raised in those eases are presented in this record, but we do not deem it necessary to discuss them. All the evidence adduced on the trial, in our'opinion, was…
