The plaintiff in error, for convenience referred to as the defendant, was convicted in the district court of Jefferson county, on a change of venue from Stephens county, of the crime of rape in the first degree, and his punishment assessed at imprisonment in the penitentiary for a term of 15 years. Upon this appeal from the judgment rendered in pursuance of the verdict, various errors are assigned, among which is the overruling of the appellant’s motion to have the case set for trial September, 1925, term of court.
