Appeal from an order of the Supreme Court (Travers, J.), entered September 24, 1992 in Albany County, which denied defendant’s motion for summary judgment dismissing the complaint.
Plaintiff allegedly sustained personal injuries when one of the rungs of the ladder that he was using slipped causing him *592to fall off the roof he was painting at defendant’s residence in the City of Albany. He thereafter commenced this action to recover damages alleging violations of Labor Law §§ 200, 240 (1) and § 241 (6).
