1Opinion of the CourtLoud, J.

This is an action brought by the plaintiff to recover damages from the defendant for failure, as a common carrier, to deliver a box of pear grafts, alleged to have been shipped over defendant’s lines. Upon the conclusion of the plaintiff’s testimony, the defendant moved for a nonsuit, on the ground that the plaintiff had failed to make out a case sufficient to be submitted to the jury. The motion was denied. The jury found a verdict for the plaintiff, upon which the court rendered judgment. The denial of a motion for a nonsuit is- the ground of the appeal.
