This is an application by the defendants Kelliher, Quinn and Brady to modify a certain injunction granted in a taxpayer’s action restraining the comptroller of the city of New York from paying salaries to them as captains in the police department of the city. To fully appreciate the situation which gave rise to the action and the present application, it seems necessary to recur to a previous taxpayer’s suit entitled Brown v.
