Tried on an information charging him with assault with intent to do great bodily harm less than the crime of murder, MCLA 750.84; MSA 28.279, defendant was convicted by a jury of felonious assault, MCLA 750.82; MSA 28.277, sentenced to serve 40 days in jail, assessed a fine and court costs, and placed on 5 years probation. Because of the importance of the legal issues raised on this appeal, the pertinent facts will be set forth in some detail.
