MEMORANDUM DECISION AND ORDER DENYING DEFENDANT’S MOTION TO DISMISS
MCMAHON, District Judge.
Plaintiff filed a class action complaint on May 23, 2001, alleging violations of the Federal Debt Collection Practices Act, (“FDCPA”), 15 U.S.C. § 1692 et seq., seeking statutory damages as well as injunctive and declaratory relief for the plaintiff and the class.
