This — a rule 37 — case involves the validity of a Commission order granting to Flanagan a permit to drill an oil well upon a one acre tract in the East Texas field as an exception to the rule in order “to prevent confiscation of property.” The case was formerly before this court in an appeal from an interlocutory order denying to the Humble a temporary injunction to prevent drilling the well pending trial upon the merits.
