The issue before the Court arises out of plaintiffs’ motion to remand.
On September 18, 1970, plaintiffs filed an information against the above named corporate defendant in the Circuit Court of the First Judicial District of Hinds County, Mississippi, seeking a forfeiture of defendant’s corporate franchises and privileges on the grounds that it has exceeded its corporate powers.
