This proceeding was instituted by the city of New York in or about the month of December, 1906, to acquire title in fee to certain lands in the city described generally as lying between East Fifteenth and East Sixteenth streets, and extending east from a line about 191 feet west of Avenue D to the pierhead line in the East river, established by the secretary of war June 9, 1903, “ excepting therefrom such portions thereof as are owned by the city of New York.” The Consolidated G-as Company of New York it was alleged is the owner, or has some interest in the lands described.
