MEMORANDUM

AUGELLI, Chief Judge:

Defendants were convicted of conspiring to transmit to the Soviet Union information relating to the national defense of the United States. The convictions, with one modification, 1 were affirmed by the Court of Appeals. United States v. Butenko, 384 F.2d 554 (3 Cir. 1967).

Following affirmance of the convictions, defendants filed petitions for certiorari in the United States Supreme Court. While the cases were pending in that Court, it was revealed that the United States had engaged in electronic surveillances which might have violated defendants’ Fourth…
