MEMORANDUM OPINION AND ORDER

JOEL PELOFSKY, Bankruptcy Judge.

Thomas Langdon Gurney, Debtor and defendant herein, and Deanna K. Gurney, Plaintiff, were married in 1958. In 1978 Thomas Gurney filed a petition in Fresno, California for the dissolution of that marriage. The Marriage Settlement Agreement entered into by the parties in connection with that dissolution purported to equally divide the community property. Deanna Gurney subsequently filed suit in the Superior Court of California, County of Fresno, in 1980, Case No. 168088, the pleadings of which are not before this Court. In the…
