MEMORANDUM OPINION AND ORDER

BATTISTI, Chief Judge.

This action comes to the Court under the Federal Tort Claims Act, 28 U.S.C. §§ 1346(b) and 2671, et seq., and the National Swine Flu Immunization Program of 1976 (Swine Flu Act), Public Law 94-380, 42 U.S.C. § 247b, et seq. The case was previously transferred by the Judicial Panel on Multidistrict Litigation to the United States District Court for the District of Columbia for consolidated pretrial proceedings.
