This action was brought in the year 1890 by William G-. Flammer to restrain the defendants from interfering with his easements of light, air and access, by the operation of their road in front of his premises, and for damages. On the 1st day of March, 1900, the ■action being at issue and still pending, Mr. Flammer sold the premises to Charlotte H. Appell. On the 21st of March, 1900, he died.
