This case was treated by the parties as one involving important issues concerning the power and authority of the Chesapeake Bay Critical Area Commission (“Critical Area Commission”) to appeal an order of a local planning commission directly to the circuit court and the construction and constitutionality of a recently enacted state statute, Section 8-1812 of the Natural Resources Article.
