PROCEDURAL AND FACTUAL BACKGROUND

This case is before the court on plaintiff’s complaint in divorce pursuant to title 23 Pa.C.S. §3301 (d). Plaintiff shall be referred to as Larry and defendant as Katherine.

Larry alleges that the parties have lived separate and apart for two years and that the marriage is irretrievably broken. This complaint filed November 20, 1995, was Larry’s second complaint in divorce under §3301(d).
